Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Sparky AI, Inc. d/b/a ArchetypeID, a Georgia corporation located at 235 Mitchell St SW, Atlanta, GA 30303. These Terms govern access to https://archetypeid.ai and to self-serve AI and behavioral simulation platforms. By creating an account, purchasing a subscription, or accessing the Services, you agree to be bound by these Terms.


If you have executed a separate Master Services Agreement, Pilot Agreement, or custom Order Form with ArchetypeID for enterprise-tier access, those terms shall supersede these web-based Terms in the event of conflict.


The Privacy Policy, Data Processing Agreement, and Acceptable Use Policy are expressly incorporated by reference.

2. Definitions

  • “Customer Property” means information, documents, prompts, or data you input into the Services (“Input”), and synthetic, predictive, or analytical output generated by the Services (“Output”).

  • “ArchetypeID Property” means the Services, underlying software, algorithms, behavioral science methodologies, and ArchetypeID’s proprietary AI assets, including Virtual Twins, Synthetic Focus Groups, and Large Scale Audience Simulation.

3. Access and Use of the Services

  • ArchetypeID grants a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Services for internal business purposes, subject to compliance with these Terms and payment of fees.

  • You shall not decipher, decompile, disassemble, or reverse-engineer the Services or ArchetypeID Property; use the Services to develop, train, fine-tune, or validate competing AI models; bypass or exploit safety filters; or use the Services for purposes prohibited by the Acceptable Use Policy.

4. Intellectual Property and Data Rights

  • You retain all right, title, and interest in your Customer Property. ArchetypeID claims no ownership over proprietary documents, scripts, or data you upload.

  • ArchetypeID retains all right, title, and exclusive interest in ArchetypeID Property, including Virtual Twins, Synthetic Focus Groups, Swarm Engine, and associated patents, copyrights, and trade secrets.

  • You grant ArchetypeID a limited, non-exclusive, royalty-free license to process your Customer Property to provide and improve the Services. ArchetypeID may utilize Customer Property to train, fine-tune, and improve our artificial intelligence models and behavioral methodologies; provided, however, that any such data used for training must be strictly aggregated and de-identified so that it cannot be linked to you, your users, or your confidential intellectual property.

5. Confidentiality

ArchetypeID will maintain confidentiality of your Customer Property and will not publish, broadcast, sell, or disclose your specific Inputs or Outputs to third parties, except as necessary to provide the Services (e.g., routing through secure enterprise cloud providers with zero-data-retention confidentiality agreements) or as required by law.

6. Subscriptions, Fees, and Payment

  • By providing a credit card or payment method, you authorize ArchetypeID or third-party payment processors (e.g., Stripe) to charge subscription fees on a recurring basis (monthly or annually).

  • Your subscription automatically renews at the end of each billing cycle unless canceled before the renewal date. If usage exceeds tier limits, ArchetypeID reserves the right to automatically upgrade your account or bill for overages.

  • You may cancel your subscription anytime through your account dashboard. Cancellations take effect at the end of the current paid term. All purchases are non-refundable; no credits are issued for partially used billing periods.

7. Disclaimer of Warranties (AI Outputs)

The Services are provided on an “as-is” and “as-available” basis. ArchetypeID provides predictive behavioral modeling and synthetic analytics. You acknowledge that Outputs generated by the Services are probabilistic computational models and do not constitute absolute factual guarantees, nor professional, financial, or legal advice. ArchetypeID specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You are solely responsible for independently verifying the accuracy and appropriateness of any AI-generated outputs prior to market deployment or reliance thereon.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall ArchetypeID, its directors, employees, or agents be liable to you for any indirect, consequential, incidental, exemplary, punitive, or special damages, including lost profits or lost data, arising from your use of the Services.


ArchetypeID’s total aggregate liability to you for any cause whatsoever shall at all times be limited to the amount actually paid by you to us for the Services during the twelve (12) months preceding the event giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless ArchetypeID and affiliates, officers, and employees from any loss, damage, liability, claim, or demand (including reasonable attorneys’ fees) by third parties arising from your Customer Property infringing third-party intellectual property or privacy rights, your breach of these Terms, or your violation of the Acceptable Use Policy.

10. Dispute Resolution and Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.

  • Any dispute arising from or relating to these Terms or the Services shall be resolved by final and binding arbitration administered by JAMS in Atlanta, Georgia, rather than in court.

  • You and ArchetypeID agree that dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Miscellaneous

These Terms, along with the Privacy Policy, DPA, and AUP, constitute the entire agreement regarding self-serve use of the Services. Failure to exercise or enforce any right does not waive it. If any provision is unlawful or unenforceable, it is severable and does not affect the remaining provisions. ArchetypeID may assign rights and obligations at any time.
