Acceptable Use Policy

1. Who We Are
We are Sparky AI, Inc., doing business as ArchetypeID (“Company,” “we,” “us,” or “our”), a company registered in Georgia, United States, at 235 Mitchell St SW, Atlanta, GA 30303. We operate the website https://archetypeid.ai (the “Site”), our proprietary behavioral simulation platforms, Virtual Twins, Synthetic Focus Groups, and related products (collectively, the “Services”).
2. AI-Specific Restrictions (Core Guardrails)
As an enterprise artificial intelligence and behavioral simulation platform, the integrity and safety of our computational models are paramount. When using the Services, you strictly agree that you may not:
Train Competing Models: use the Services, including any generated data, responses, or outputs, to develop, train, fine-tune, benchmark, or validate any foundational or competing AI models, algorithms, or platforms.
Jailbreak or Exploit: engage in prompt injection, adversarial testing, “jailbreaking,” or any attempt to bypass, disable, manipulate, or exploit the safety filters, system prompts, or underlying computational engines of the Services.
Create Unauthorized Digital Clones: use the Services to create Virtual Twins, digital replicas, or behavioral simulations of specific, identifiable real-world individuals (including private citizens, politicians, celebrities, or public figures) without their explicit, legally verifiable, written consent. The Services are strictly intended for demographic, psychometric, and aggregate audience simulation.
Engage in High-Risk Automated Decision Making: use predictive or behavioral outputs to make or automate “High-Risk” decisions that legally or significantly affect individuals. This includes eligibility for credit, lending, housing, employment, healthcare, insurance, or legal/fundamental rights.
Generate Disinformation: use the Services to generate, scale, or disseminate political disinformation, fraudulent news, synthetic propaganda, or campaigns designed to manipulate electoral or democratic processes.
3. General Use of the Services
When you use the Services you warrant that you will comply with this Policy and with all applicable laws. You acknowledge that you may not:
Decipher, decompile, disassemble, or reverse engineer any of the software or models comprising the Services.
Systematically retrieve data or other content to create a collection, compilation, database, or directory without written permission from us.
Circumvent, disable, or otherwise interfere with security-related features of the Services.
Interfere with, disrupt, or create an undue burden on the Services, its networks, or its cloud infrastructure.
Engage in any automated use of the Services outside of the approved API limits and documentation provided by us.
Upload or transmit viruses, Trojan horses, or other malicious material that interferes with any party’s use of the Services.
4. Content Contributions and Uploads
The Services allow users to upload, transmit, or process Content (including text, video, audio, scripts, and strategic briefs) for analysis by our synthetic models. You warrant that you own or have the necessary rights to authorize us to process your Content, that your Content does not infringe any third-party proprietary or privacy rights, and that you will not process, transmit, or upload any Content that:
Is defamatory, obscene, offensive, hateful, intimidating, bullying, abusive, or threatening.
Includes child sexual abuse material (CSAM) or violates any law protecting minors.
Promotes violence, advocates the violent overthrow of any government, or threatens physical harm against another.
Promotes, facilitates, or assists acts of terrorism.
Contains sensitive personal information (such as Social Security Numbers, protected health information under HIPAA, or unmasked financial data) unless explicitly authorized under a separate Data Processing Agreement (DPA) with us.
5. Consequences of Breaching This Policy
The consequences for violating this Policy will vary depending on the severity of the breach. In some cases we may give you a warning or remove the infringing Content. If your breach is serious, or if you violate the AI-Specific Restrictions in Section 2, we reserve the right to immediately suspend or terminate your access to the Services without refund.
We may also notify law enforcement or issue legal proceedings against you when we believe there is a genuine risk to an individual, a threat to public safety, or a severe violation of our intellectual property rights. We exclude our liability for all action we may take in response to any of your breaches of this Policy.
6. Disclaimer on Predictive Outputs
ArchetypeID provides predictive behavioral modeling and synthetic analytics. The outputs generated by the Services are probabilistic computational models and do not constitute absolute factual guarantees or professional financial, legal, or medical advice. You are solely responsible for independently verifying the accuracy and appropriateness of any AI-generated outputs prior to live market deployment or public release. ArchetypeID disclaims any liability for commercial losses, campaign performance, or reputational damages resulting from your reliance on the Services.
